CHAPTER ONE

INTRODUCTION

Background of the study

A political system cannot be deemed comprehensive and democratic unless it incorporates a system of local governance as the presence of local government, has always been justified on the grounds that it plays a vital role in the democratization process and the promotion of widespread involvement in decision-making. According to GüNer, & Yilmaz, (2017), the local government has a dual function -to fulfil administrative functions by providing products and services and to engage and include residents in identifying local public need and devising strategies to address them. 

To comprehend the operation and organization of local government, it is crucial to establish a clear definition of local government and grasp the significance of local government democracy and principles. As stated by Kocaoğlu Uçar & Öktem, (2016), the importance of local governance the administrative structure of local government serves as the fundamental framework for determining and implementing local public policy. Hence, the composition of councils and their activities and independence of local councils has emerged as a prominent characteristic of modern local government systems in recent years. 

Contextually, in Cameroon, the decentralization process began in the late 1990s, with the objective of providing local governments with more autonomy and improving their ability to efficiently handle local matters (Nkwi, 2018). The Constitution of Cameroon establishes a decentralised unitary state, with legislation in place to define the authority and responsibilities of local councils (Öktem & Çiftçi, 2016). Decentralization changes, which include transferring political authority and responsibility to government levels that are closer to the public, have been gradually implemented worldwide since the 1980s (Ozden, 2017). Although both local autonomy and decentralization have been widely supported by prominent European and international organizations as crucial elements of "good governance" (Ozden, 2017) to strengthen local democracy and efficiency. One way to achieve this is by increasing citizen participation in the political process, enhancing decision-making accountability, improving economic efficiency, promoting healthy competition and cross-functional coordination at the local level, supporting policy experimentation, and safeguarding macroeconomic and political stability. 

Drawing inference from the Council of Europe implemented the via European Charter of Local Self-Government" in 1985, Tan, (2018), this charter is an international legal document that guarantees the safeguarding, assessment, and advancement of principles related to decentralisation and local autonomy. It states that local authorities should have democratically established decision-making bodies and possess a significant level of independence in carrying out their responsibilities, determining the methods and resources needed to fulfil them. Given the significance of local government in promoting sustainable development and democratic governance, it is essential to evaluate the issues that hinder the independence of municipal councils in Cameroon. This study seeks to get a deeper understanding of these difficulties and provide suggestions to enhance the effectiveness of local administration in the country.

Statement of the problem 

In recent times, municipal councils in Cameroon have a crucial role in local administration and development. They are responsible for managing communal affairs, providing important public services, and reflecting the interests of the people they serve. Although a decentralized system has been formally established in Cameroon with the aim of empowering local governments, municipal councils nevertheless face substantial constraints on their authority/. In a study by Jua (2019), the implementation of decentralization in Cameroon has encountered various challenges that impedes  the complete achievement of municipal autonomy, such as ambiguous legislative frameworks, insufficient financial resources, and intervention from governmental entities. Similarly,  Tchatchoua-Djomo & Noutcheu, (2020) mentioned that municipal councils often face challenges in exercising their decision-making power due to restricted jurisdiction, financial constraints, and administrative obstacles. These limitations hinder their capacity to act autonomously and effectively address local needs 

Additionally, Ake (2018) mentioned that the autonomy of municipal councils is hindered by many reasons, such as ambiguous and sometimes conflicting legislative frameworks, limited financial resources, excessive supervision by the central government, and political meddling (Ake, 2018). These obstacles impede the autonomy of municipal councils, impair their capacity to efficiently allocate finances, and impede their ability to meet local priorities and needs. The absence of self-governance hinders the capacity of local authorities to promote democratic engagement, responsibility, and progress at the community level. This presents a danger to the efficient provision of public services and weakens the overall objectives of decentralisation in Cameroon (Nkwi, 2018). Therefore, it is important to analyse the issues that limit municipal autonomy and suggest methods to enhance local administration in the nation..

1.3 Objective of the study

The broad objective of the study is to assess the factors mitigating against the autonomy of municipal councils in Cameroon. The specific objectives is as follows

Assess the extent to which political interplay influence the independence of municipal councils.

Examine the factors mitigating against the autonomy of municipal councils in Cameroon

Ascertain the effect of lack of autonomy on  service delivery and  local governance in Cameroon

1.4 Research Questions

The following questions have been prepared for the following

What is the extent to which political interplay influence the independence of municipal councils?

What are the factors mitigating against the autonomy of municipal councils in Cameroon?

What is the effect of lack of autonomy on service delivery and local governance in Cameroon?

1.5 Research Hypotheses

Ho: There is no significant effect of lack of autonomy on service delivery and local governance in Cameroon

Ha: There is a significant effect of lack of autonomy on service delivery and local governance in Cameroon

1.6 Significance of the study

Practically, by identifying the specific factors hindering municipal autonomy, the study can inform policymakers in Cameroon and guide them in formulating effective reforms that enhance local governance and empower municipal councils. Empirically, the research adds to the existing body of knowledge on local governance and decentralization in Cameroon, providing a foundation for further academic inquiry and comparative studies in other contexts.

1.7 Scope of the study

The study focuses on the factors mitigating against the autonomy of municipal councils in cameroon. Empirically, the study will assess the extent to which political interplay influence the independence of municipal councils, examine the factors mitigating against the autonomy of municipal councils in cameroon and evaluate the administrative challenges faced by municipal councils on local governance and autonomy.

1.8 Limitation of the study

Like in every human endeavour, the researchers encountered slight constraints while carrying out the study. Insufficient funds tend to impede the efficiency of the researcher in sourcing for the relevant materials, literature, or information and in the process of data collection (internet, questionnaire, and interview), which is why the researcher resorted to a moderate choice of sample size. More so, the researcher will simultaneously engage in this study with other academic work. As a result, the amount of time spent on research will be reduced.

1.8 Definition of terms

Autonomy: In the context of municipal governance, autonomy refers to the ability of municipal councils to make decisions independently, manage resources, and administer local affairs without undue external interference, particularly from higher levels of government.

Municipal Councils: These are local government bodies responsible for administering and governing municipalities or local jurisdictions. They are elected and tasked with making decisions on local policies, budgets, and services for their constituents.

Decentralization: Decentralization is the process of distributing power, authority, and resources from the central government to local levels of government. In the context of municipal councils, it implies a transfer of governance responsibilities and autonomy to local entities.
